    Angelina Jolie and Brad Pitt have reached a temporary custody agreement

    The estranged couple have been locked in a bitter war over their six children Maddox, 15, Pax, 13, Zahara, 11, Shiloh, 10, and eight-year-old twins Knox and Vivienne since the beginning of September but, according to court documents, a judge has granted the 41-year-old actress sole legal guardianship of her kids.


    According to the legal paperwork obtained by 'Entertainment Tonight', the 52-year-old hunk will continue to have "therapeutic visitations" with the children, as previously agreed on October 2, but it'll be down to the family's therapist - who "shall at all times consider the best interests of the minors" - whether the kids want to see him.

    The judge has also made it mandatory for Brad to participate in random drug and alcohol testing - something he previously volunteered to do on an ad hoc basis - as well as attend weekly individual and group therapy sessions with a counsellor.

    A source said: "Originally, Pitt had volunteered to do the drug and alcohol testing himself. But now that a judge has signed off on these docs, it has become mandatory and cannot be reversed without another court filing."

    And, although the festive season is a time for family, the 'Allied' star may be forced to spend Christmas alone this year as it'll be down to the children whether he sees them.

    The insider explained: "If a child says they don't want to see Brad on Christmas, the psychiatrist isn't going to force them. That's the whole purpose of this agreement."

    The new custody agreement is no doubt a kick in the teeth for Brad as he hasn't seen his children without a therapist present since he was accused of lashing out at his eldest son Maddox while on board a private plane with his family in September.

    Brad has since been cleared of child abuse allegations after weeks of intensive investigations carried out by police and the FBI but Angelina is still unsure of him.

    A source said: "Brad has not seen his children alone without a monitored therapist since the plane incident. Angelina has not left the children's side since the plane incident. She still has not completed her film ['First They Killed My Father']. She has been with them the whole time trying to make sure they heal."

    After the alleged incident on board the jet, Angelina filed for divorce from Brad, whom she has been with since 2005, following just two years of marriage.
