Notorious prisoner Philip John Smith has lost his latest court battle

Notorious prisoner Philip John Smith has lost his latest court battle

The convicted murderer and child sex offender - who fled to Brazil during a weekend home pass in 2014 - had taken Corrections to court, saying it failed to provide him with adequate rehabilitation.

But in a judgment released today, Justice Jan-Marie Doogue has rejected the claim.

She says Corrections has provided Smith with significant rehabilitative services throughout his time in prison.

The judge goes on to say it is not Corrections who has failed Smith - he has failed himself in not learning from the treatment provided - and actively scheming to reoffend.

She says he must take responsibility for that.
