    The National Emergency Management Agency has won a bid to dismiss a WorkSafe charge -- in relation to the 2019 Whakaari eruption that resulted in the deaths of 22 people


    The agency is one of 13 defendants charged with health and safety breaches.

    Forty-seven people were on the volcanic island when it erupted - 22 died -and many were seriously injured.

    NEMA last week made a legal challenge in the Whakatane District Court, arguing the Crown agency's responsibilities are narrower than WorkSafe alleged - and NEMA did not have a local operational role.
